Terms of Service

1. Acceptance of Terms

By accessing or using any website, application, or service operated by IndieClub LLC ("Company," "we," "us," or "our"), including IndieClub, KillerPuzzles, and VoiceComics (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

The Platform is operated by IndieClub LLC, doing business as KillerPuzzles and VoiceComics, located at PO Box 565, Winlock, WA 98596.

2. Eligibility

You must be at least 13 years of age to use the Platform. By creating an account, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).

3. One Account, Three Platforms

A single account provides access to all three platforms operated by the Company: IndieClub (indieclub.com), KillerPuzzles (killerpuzzles.com), and VoiceComics (voicecomics.com). These Terms govern your use of all three platforms. Your account, profile, purchases, Gold Coins, and progress are shared across all platforms.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You must notify us immediately of any unauthorized use of your account.

You may not share your account with others, create multiple accounts, or use automated means to create accounts.

5. Content & Intellectual Property

Platform Content: All content provided by the Company, including but not limited to text, graphics, logos, images, audio, video, software, and interactive features, is owned by the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws.

User Content: By submitting content to the Platform (including but not limited to forum posts, messages, profile information, and reviews), you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute such content in connection with operating the Platform.

Creator Content: Creators who publish comics, films, books, or other works on the Platform are subject to separate creator agreements that govern content licensing, revenue sharing, and publishing terms. These Terms do not supersede any executed creator agreement.

6. Purchases & Payments

The Platform offers digital content for purchase, including but not limited to comics, films, books, and bundles. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

No Refunds: All digital content purchases are final and non-refundable once access has been granted or viewing has begun. This includes purchased comics, film rentals, and digital bundles. If you experience a technical issue that prevents you from accessing purchased content, please contact us and we will work to resolve the issue.

Film Rentals: Rented films are available for a limited time period as specified at the time of rental. Access expires at the end of the rental period regardless of whether the content has been viewed. Rental periods are non-extendable and non-refundable.

Prices are listed in US dollars and are subject to change. We reserve the right to modify pricing, offer promotions, and discontinue products at any time.

7. Gold Coins & Virtual Rewards

The Platform features a rewards system using virtual currency called "Gold Coins." The following terms apply to Gold Coins and all virtual rewards:

  • Gold Coins have no real-world monetary value and cannot be exchanged, refunded, or redeemed for cash, credit, or any form of legal tender.
  • Gold Coins are non-transferable between accounts and may not be sold, traded, or gifted to other users.
  • Gold Coins are earned through various platform activities available to all users, including daily logins, completing content, finding treasure codes, solving mysteries, following creators, and other engagement activities.
  • Content that contains hidden treasure codes or mystery elements requires skill and effort to discover — including finding clues, solving puzzles, and completing challenges. This is not a game of chance.
  • Gold Coins may be used to acquire digital perks, profile upgrades, and bonus content within the Platform's shop. Some bonus content in the shop may be provided by third-party creators; the Company is not responsible for the quality or availability of third-party content.
  • The Company reserves the right to modify, adjust, or discontinue the Gold Coin system, reward amounts, shop prices, or any virtual rewards at any time without prior notice.
  • Gold Coins may be revoked or adjusted if obtained through fraud, exploitation of bugs, manipulation, or violation of these Terms.
  • Upon account termination, all Gold Coins and virtual rewards are forfeited.

8. Prohibited Conduct

You agree not to:

  • Violate any applicable law, regulation, or third-party rights
  • Harass, threaten, bully, or intimidate other users
  • Post or transmit content that is obscene, defamatory, hateful, or promotes violence
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use bots, scrapers, or automated tools to access the Platform
  • Attempt to exploit bugs, glitches, or vulnerabilities to gain unfair advantages or accumulate Gold Coins
  • Circumvent or disable any security features of the Platform
  • Distribute, reproduce, or publicly display any Platform content without authorization
  • Use the Platform for spam, phishing, or any fraudulent purpose
  • Create multiple accounts to abuse referral programs, promotions, or reward systems

9. Copyright & DMCA

We respect the intellectual property rights of others. If you believe content on the Platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent at:

Your notice must include: identification of the copyrighted work, identification of the infringing material with sufficient detail to locate it, your contact information, a statement that you have a good faith belief the use is not authorized, and a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf.

10. Termination & Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Any Gold Coins, virtual rewards, and access to purchased content may be forfeited upon termination for cause.

You may delete your account at any time by contacting us. Account deletion is permanent and cannot be undone.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Third-party content, including creator-published works and bonus content in the shop, is provided by independent parties. The Company does not guarantee the quality, accuracy, or availability of third-party content.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDIECLUB LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOLD COINS OR VIRTUAL REWARDS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless IndieClub LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in Washington State, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
